Brain Injury from Birth

One of the most serious birth injuries a baby can suffer is a brain trauma. Brain trauma is a diagnosis that can affect the child throughout their entire life, affecting their ability to develop and grow normally.

Head trauma may occur during delivery and can lead to a number of conditions for the infant including caput succedaneum, cephalohematoma, normal head deformity due to birth forces, subgaleal hemorrhage, subdural hemorrhage, subarachnoid hemorrhage, and epidural hemorrhage.

A brain trauma that occurs during the delivery process can be caused by decreased oxygen (hypoxia) and decreased blood flow to a baby’s brain (ischemia).

A brain trauma during delivery is rare and usually the cause of medical negligence.

If brain damage has been caused by medical negligence and a birth injury, parents who believe the hospital is at fault generally want to know whether the accident could have been prevented. If it was caused by an injury during the perinatal period (around the time of birth) and could have been avoided, a valid compensation claim could arise.

Anyone who has been the victim of a birth trauma that has resulted in a brain injury, as the result of medical negligence, is eligible to recover medical and hospital expenses to cover the care of the child. The first step is to have your case evaluated by an experienced law firm to find out your legal options.
